1. What to do if the police or immigration agents detain you: YOUR RIGHTS

You have the right to remain silent.

You have the right to say no to a search of yourself, your vehicle, or your home.

If you’re not under arrest, you have the right to calmly leave.

You have constitutional rights regardless of your immigration or citizenship status.

2. What to do if the police or immigration agents detain you: YOUR RESPONSIBILITIES

Stay calm.

Don’t interfere with or obstruct the police.

Don’t lie or give them fake documents.

Prepare yourself and your family in case you are arrested.

Remember the details of the incident.

Prepare your legal case if you think your rights have been violated.

3. If you are stopped in your vehicle

Pull over safely, turn off the car, turn on the interior light, slightly open the window, and keep your hands on the steering wheel.

You can refuse a car search, but officers may search without permission if they believe it contains evidence of a crime.

Drivers and passengers have the right to remain silent. Passengers may ask if they’re free to go; if yes, leave calmly, and if no, they can still remain silent.

If they ask for it, show your car registration, insurance, and license (if you have it).

4. If the police or immigration agents come to your home

You do not have to let them in unless they have a judicial warrant signed by a judge that lists your address.

You can ask the officer to slide the warrant under the door or hold it up in front of a window to review.

5. Types of Warrants

"Search Warrants": Allows police to enter the address listed BUT only to search areas and articles mentioned.

"Arrest Warrants": Allows police to enter the home of the person named on the warrant if they think they’ll find them inside.

"ICE Warrant": Alone, does not permit agents to enter without permission. If you engage, step out and close the door behind you.

6. If they stop & question you on the street

Stay calm and do not flee. Do not converse. Keep your hands visible.

Ask if you’re free to go. If yes, leave calmly and silently. If they arrest you, you have the right to know why.

You have the right to remain silent. You don’t have to disclose your immigration status/place of birth.

Don’t lie about your immigration or citizenship status or give fake documents.

If your rights are violated, file a complaint. Write it down.

7. If you are arrested

You have the right to ask for a lawyer and to remain silent.

Do not resist, even if you’re being unjustly arrested. That will be fought in court.

Arrange an emergency plan with your friends/family in case you are arrested.

Memorize phone numbers of trusted members. Make an emergency plan if you have kids or take medications.

8. If you aren't a citizen

Don’t talk about your immigration status with anyone other than your lawyer. When in jail, you may have an immigration agent visit you. You have the right to not respond to questions or sign anything.

Read documents carefully. If you do not understand, ask for an interpreter.

You have the right to communicate with your consulate or that an official notify your consulate of your arrest.

Independientemente de su estatus migratorio o ciudadanía, tiene derechos constitucionales.

2. QUE DEBE HACER SI LA POLICIA O AGENTES DE INMIGRACION LO DETIENEN: SUS RESPONSABILIDADES

Mantenga la calma y sea respetuoso.

No interfiera ni obstruya a las autoridades.

No mienta ni entregue documentos falsos.

Prepárese a sí mismo y a su familia en caso de que lo arresten.

Recuerde los detalles del incidente.

Si cree que sus derechos fueron violados, documente lo ocurrido y considere presentar una denuncia posteriormente.

3. SI LO PARAN EN SU VEHÍCULO

Detenga el vehículo en un lugar seguro lo antes posible. Apague el motor, encienda la luz interior, baje un poco la ventana y mantenga las manos visibles sobre el volante.

Si un agente le pide registrar el interior del vehículo, usted puede decir: “No doy mi consentimiento.” Pero solo si tiene causa probable de que haya evidencia de un delito.

Conductores y pasajeros tienen el derecho a permanecer en silencio.

Si usted es pasajero, puede preguntar: “¿Estoy libre de irme?”

— Si el oficial dice que sí, puede retirarse con calma.

— Si dice que no, permanezca en silencio.

Si se lo solicitan, muestre su registro, seguro y licencia de conducir (si la tiene).

4. SI LA POLICÍA O AGENTES DE INMIGRACIÓN LLEGAN A SU CASA

Usted no tiene que permitirles entrar a menos que tengan una orden judicial válida firmada por un juez.

Puede pedir que deslicen la orden por debajo de la puerta o que la muestren por una ventana para revisarla.

No abra la puerta ni permita la entrada sin una orden válida.

5. TIPOS DE ÓRDENES JUDICIALES

"ORDEN DE CATEO"

Debe estar firmada por un juez.

Permite a la policía entrar únicamente a la dirección indicada y solo para buscar las áreas y objetos mencionados.

"ORDEN DE ARRESTO"

Debe estar firmada por un juez.

Permite a la policía entrar solo a la vivienda de la persona nombrada en la orden si cree que se encuentra allí.

No autoriza entrar a la casa de otra persona sin una orden de cateo o consentimiento.

"ORDEN ADMINISTRATIVA DE INMIGRACIÓN" 

No está firmada por un juez. No autoriza a los agentes a entrar a su casa sin su permiso.

6. SI LO PARAN EN LA CALLE PARA CUESTIONARLO

Mantenga la calma. No huya ni discuta con los agentes. Mantenga las manos visibles.

Pregunte: “¿Estoy libre de irme?”

Si la respuesta es sí, retírese con calma y en silencio.

Si lo arrestan, tiene derecho a saber por qué.

Usted tiene derecho a permanecer en silencio y no hablar sobre su estatus migratorio o ciudadanía.

No mienta ni entregue documentos falsos.

Si cree que sus derechos fueron violados, anote todo lo ocurrido para presentar una denuncia más adelante.

7. SI LO ARRESTAN

No oponga resistencia, incluso si cree que el arresto es injusto.

Prepárese a sí mismo y a su familia. Memorice los números de teléfono de familiares y de su abogado.

Prepare un plan de emergencia si tiene hijos o toma medicamentos.

8. SI USTED NO ES CIUDADANO

No hable de su estatus migratorio con nadie excepto su abogado. Mientras se encuentra en la cárcel, es posible que le visite un agente de inmigración. Tiene derecho a no responder preguntas ni firmar nada antes de hablar con un abogado. Lea cuidadosamente los documentos. Si no los entiende, pida un intérprete.

Usted tiene derecho a comunicarse con su consulado o a que un oficial notifique al consulado de su arresto.
